Industry members are prohibited from:
- Paying or crediting a retailer, directly or indirectly, for advertising, display, or distribution service if the act results in exclusion. Examples include, but are not limited to:
- Making payments or credits to retailers that are reimbursements for services purchased by a retailer from a third party
- Directly or indirectly sharing the cost of an advertisement with a retailer
- Purchasing advertising from a retailer
- Providing reimbursements to retailers for setting up product displays or other displays
- Paying the retailer through a promotion where the industry member rents display space at a retail establishment
Industry members are allowed to:
- Give or sell newspaper cuts, mats, or engraved blocks to a retailer selling the industry member’s product(s) for use in the retailer’s advertisements
- List the names and addresses of two or more unaffiliated retailers selling an industry member’s product(s) in an industry member’s advertisement provided all of the following conditions are met:
- The advertisement does not contain the retail price of the industry member’s product(s)
- The listing of the names and addresses of the retailers is the only reference to the retailers in the advertisement and is not the focus of the advertisement
- The advertisement does not refer to only one retailer, or only to retail establishments controlled directly or indirectly by the same retailer
