An industry member can give a retailer product for the purpose of market research, education, promotion of the product, or determination of the flavor of the product.
The retailer receiving the product cannot have purchased that brand from the industry member within the preceding 12 months.
Product given to a retailer cannot exceed the following amounts within a calendar year:
- Three liters of any brand of alcoholic liquor
- Three liters of any brand of wine
- Three gallons of any brand of beer
An industry member must obtain any product used for sampling from the respective wholesaler. For alcoholic liquor, the industry member must have all products delivered to the Department’s warehouse prior to sampling. The industry member must then contact the Department before removing product(s) for sampling.
Each container of product used for sampling must be clearly marked with the word “SAMPLE”. The marking cannot obscure the label of the container.
An industry member must keep and maintain records related to sampling.
