An industry member may furnish, give, or sell consumer advertising specialties to a retailer.
Consumer advertising specialties include, but are not limited to:
- Nonalcoholic mixers
- Bottle or can openers
- Corkscrews
- Shopping bags
- Matches
- Printed recipes
- Pamphlets
- Cards
- Leaflets
- Blotters
- Postcards
- Pens or pencils
- Shirts
- Caps
- Visors
There cannot be conditions placed on the distribution of the consumer advertising specialties by the retailer to consumers. An industry member cannot pay or credit a retailer to distribute consumer advertising specialties or for any expenses incidental to their use.
Consumer advertising specialties must bear easily seen, substantial advertising matter about the industry member or the industry memberβs product that is permanently inscribed or securely affixed.
There is no dollar limitation on consumer advertising specialties.
If a consumer advertising specialty also advertises a local event not sponsored by the retailer, the consumer advertising specialty only has to be offered to retailers within the local community where the event is held.
Industry members are required to keep records for a three-year period regarding any consumer advertising specialties furnished, given, or sold to retailers.
