An industry member can supply, give, or sell retailer advertising utensils.
These are items which are primarily valuable as point-of-sale advertising intended for use on the premises of a retail establishment. Examples include, but are not limited to:
- Posters
- Placards
- Designs
- Inside signs (electric, mechanical, or otherwise)
- Billboards
- Window decorations
- Trays
- Coasters
- Mats
- Menu cards
- Meal checks
- Paper napkins
- Foam scrapers
- Back bar mats
- Thermometers
- Clocks
- Calendars
- Alcoholic beverage lists or menus
All retailer advertising utensils must have easily seen and substantial advertising matter about the industry member or the industry memberβs product(s). The advertising matter must be permanently inscribed or securely affixed. The name and address of the retailer may appear on the material(s).
An industry member cannot pay or credit a retailer, directly or indirectly, for using retailer advertising utensils or for any expense incidental to their use.
Industry members must keep and maintain records of retailer advertising utensils supplied, given, or sold.
